Convicted lawyers get bail

Convicted lawyers Lyndon Mothusi and Herbert Sikhakhane were yesterday sentenced to an effective 18 months and six months' imprisonment, respectively, by the Gaborone Village Magistrates Court.

Assistant Registrar and Master of the High Court Nelson Bopa had suspended a bulk of the sentences on condition that the duo  not be convicted of the same offences. They were convicted of conspiracy to defraud and attempting to obtain money by false pretences. However, Mothusi's crimes were major. In addition, he was convicted of other crimes such as obtaining by false pretences and money-laundering.

Bopa said that he had weighed the seriousness of the offences, and the interest of both the accused persons and those of the state to come up with a fair sentence. He said that the conviction of the two lawyers had brought into disrepute the legal profession and the Administration of Justice in Botswana because they went against what the legal profession is all about. He said that the manner in which the offences were executed was disturbing and that the sentence should send a clear message that "crime does not pay".
