Botswana fails in core obligations - UB lecturer

A law lecturer has argued that Botswana has failed to meet its minimum obligations to the residents of Central Kalahari Game Reserve (CKGR) by denying them food.

University of Botswana (UB) academic, Bonolo Ramadi Dinokopila wrote in the African Law Journal 2013 that when the government terminated the supply of food rations to the people of the CKGR, it violated several provisions of the African Charter. In an article entitled: "The Judicial Enforcement Of Socio-Economic Rights In Botswana: Prospects And Challenges",he examined various provisions of the African Charter in the light of the famous (Roy) Sesana and others vs the Government of Botswana case of 2006.

He said Article 4 of the African Charter provides that "every human being shall be entitled to respect for his life and the integrity of his person". He said the right to life entails both a negative obligation not to take someone's life and a positive obligation to protect the right to life. These positive measures include the provision of some commodities to keep one alive, he added.
