Homosexuality is regarded as abominable and sinful, it is perceived as a crime and homosexual sex is punishable with a possible jail sentence if convicted.
Section 164 of the Penal Code defines it as "carnal knowledge of any person against the order of nature..., carnal knowledge of animals or permits carnal knowledge of him/her against the order of nature..."
While it is widely acknowledged that Khama holds the title of Kgosi, the government’s failure to properly gazette his recognition has raised serious concerns about adherence to legal procedures and the credibility of traditional leadership.
