Appellant admits robbery, not rape

FRANCISTOWN: An appellant in a double rape and robbery case has denied the rape saying he only committed the robbery.

Boyce Phenyo appeared before Justice Zibani Makhwade last week to appeal his three convictions on robbery and two rapes for which he was sentenced to 30 years' imprisonment. Effectively his sentence was 10 years as the sentences were ordered to run concurrently. He told the court that he did not commit the offences of rape he was charged with.

Phenyo is said to have robbed and raped a 29-year old woman in Bolatlhapeo Lands around Dibete on October 29, 2009 and also raped a 12-year old girl in the same area on April 1, 2010.Phenyo further told the court that he was asking the court for leniency on his robbery sentence and but denied that he ever raped any of the complainants, as charged.
