Act amendment angers chiefs

The minister was presenting the Bogosi Bill whose objective is to re-enact with amendments, the law relating to Bogosi. She said that the Bill is a result of Constitutional Amendments to Section 77, 78 and 79 which sought to reconstitute Ntlo ya Dikgosi.
She added that the High Court decision in the case of Kamanakao and others against the Attorney General also had an influence in the framing of the Bill. "This was a case brought by Kamanakao and Wayei which held that the definitions and the words "Chief" and "Tribe" contained in the Chieftainship Act were too restrictive and discriminatory, and as such offended against the constitution," she said. Nasha informed the House that the High Court recommended that the Chieftainship Act should be amended by redefining those words in order to accord equal treatment to all tribes in the country.
