Robbers get 20 years in jail

FRANCISTOWN: Three men who committed two robberies last March have been sent to jail for 10 years on each count. "The sentences are to run concurrently," said chief magistrate Kenneth Obeng. In a packed courtroom, relatives and sympathisers of Benjamin Kgaboe 43, Babili Poloko 26 and Kebonang Motlhoka 25 whimpered when Obeng read the law on robbery.

It dawned on them that the accused would not get a sentence of less than 10 years. The three convicts robbed two men last year and then called Kutlwano Police station to say they had just witnessed a kidnapping. In court they admitted this was a false report.

In his sentence, Obeng said that though he was touched by the mitigation of one of the convicts,  his hands are tied and he had to do what the law requires. "As far as robbery is concerned, if people are acting in consent in committing this crime, the state demands that they be sentenced to not less than 10 years. So I do not have a choice," he said.
Filing a false report is a crime on its own and it worked against the convicts during judgment even though they were not charged with the offence.
