Woman has case to answer in Mphathi suit

 

The case is set to continue from October 20 after defence counsel, Isaac Seleka, failed in his 'no case to answer' application for his client, One Gwafila. The woman is accused of causing unlawful injury to Vinga, Mphathi's spouse.She is alleged to have committed the offences through intimidating cellphone messages.

In the previous mention in February, proceedings were adjourned after one of the defence attorneys, Tshekiso Tshekiso, objected to the evidence of Robert Mathumo, Orange Botswana legal administration officer.Tshekiso stated that Mathumo did not provide the court with mobile phone text communication between Vinga and Gwafila as reflected in the charge sheet but was giving evidence of voice communication. He said Mathumo had told the court that he was not the person who extracted the information showing the alleged text communication between Gwafila and Vinga.

He wondered how the witness could vouch for the authenticity of the information he did not personally extract from the computer system.Gwafila is alleged to have sent text message to Vinga that read: 'Go tswa mo go lona (It is up to you), You can sue or will e-mail what am about, or hear from the public latest technology, social network, biggest scandal of the year thanx to makgakga a some people. (sic)'This is an angry person who will do anything to vent (her anger). Sowa Town will soon know what they are dealing with' or words of a similar nature.

In the second count Gwafila is alleged to have sent a message saying that: 'People who are promiscuous need to be exposed, ke ne kere o Mma Mphathi (I thought that you are Montwedi Mphathi's wife)' or words of a similar nature.In count three, Gwafila is said to have sent a message saying that: 'Ke ditiro tsa monna bare wena or worse mo di promiscuiting but you will get the revelations before the end of this weekend, I am still compiling' or words of a similar nature.In the fourth count, she is alleged to have sent a text with the following message: 'It's on its way... the things you never knew... what a revelation this is going to be, like they say never say o itse motho... let's al wait and see'. (sic)

In the last count, she is accused of sending a message saying that: 'Sorry to involve you but some things are better said or put there for people to have an idea of what they are.'
