Teacher, computer technician accused of forgery

The state alleges that the teacher, Msindisi Majama, 45, and Zimbabwean national Tolani Nyoni, 29, and another accused who was not before court, acting together with common purpose, with intent to defraud Aptec Computers made a false document with a Government Purchase Order (GPO) purporting to have been issued by FSSS to Aptec Computers.

The charge sheet further states that the accused wanted to purchase seven laptops, each valued at P8,799, one printer valued at P1,099 and two Samsung TAB each valued at P6,199 purporting to be bought by FSSS from Aptec computers.

The incident allegedly took place on March 18, 2013 at or near the premises of Promvi Holdings, which the duo allegedly operates in Francistown.

The prosecutor Mompoloki Gaboiphithwe told court that the investigating officer, Stunki Mogorosi from Tatitown Police Station has informed her that investigations in the case are still ongoing.  She applied that Nyoni be kept in custody as he might skip the country if granted bail.

Gaboiphithwe said that the investigating officer also informed her that Nyoni entered the country illegally because his passport shows that he once left the country but it does not reflect when he returned to Botswana.

In concurrence with the prosecutor, Siziba granted Majama bail on condition that he reports to Tatitown Police Station fortnightly, surrender his passport to the Station Commander of the same police station, inform the police whenever he wants to travel outside the country, attend court as scheduled and does not commit any other crime while on bail.  Siziba, however, denied Nyoni bail because his passport shows that he travels a lot throughout Southern Africa. He therefore ordered that Nyoni be remanded in custody.
