This comes in the wake of a threat by Mogalakwe to take the party to court. In the latest development, the party's lawyers, Langwane Mmekwa have boldly stated that the party has made a decision not to reinstate Mogalakwe or agree to his demands.
This comes as a response to an ultimatum by Mogalakwe, filed through attorneys, Bayford and Associates, giving the party up to seven days to reinstate Mogalakwe.
Mogalakwe contends that the party central committee erred by relying on a report of a disciplinary committee chaired by Lemogang Ntime who has just been re- admitted into the party.
A letter from the BNF attorneys states that the party has done nothing wrong in law or procedurally as alleged by Mogalakwe. 'As far as our client is concerned, it acted within the scope and spirit of its constitution and related codes', reads the response.
Mogalakwe believes that the central committee erred by failing to give him a hearing prior to its decision that was supposed to enhance a sentence recommended to it by the party's national disciplinary committee.
He challenges the BNF central committee for overruling a recommendation for a six months suspension as a result of the charges laid against him.
On this point, BNF lawyers argue that Mogalakwe deliberately slept on his right when he failed to appeal the central committee's decision immediately after his expulsion from the party.
The BNF further states that Mogalakwe's attitude towards the party central committee was the cause of all these blunders.
'The door is still open for him to smoke the peace pipe and follow the party's structures without resorting to court,' reads the letter from the party attorneys.
In reaction, the maverick Mosolotshane ward councilor wants an extraordinary congress to hear his case.
