Old man slaps nephew with P46,000 suit

Self-represented Hunter Banyatsang told the court that the claim is for the damages he suffered on his body and the spectacles that his nephew, Thambane Badimo broke during the assault in 2006. 'He hit me on the forehead breaking my spectacles,' said the old man. 'I also lost a tooth and the other one has cracked since then,' the old man added.

He told the court that he suffered body pains from the punches administered on him by his nephew. He said he wants P40,000 for the damage to the body and P6,000 for the spectacles. The old man said things took a nasty turn after he gave his nephew notice to vacate the house that he was renting.

He said the nephew refused to vacate the house and he was forced to deny him access to water. 'He refused to vacate the house and my worry was the bills which were increasing,' he said. 'That fateful day, I was at the stand-pipe with my wife and our son when he came to fetch water. I held the pipe with a hand and he tried to remove it but was unsuccessful,' Banyatsang explained. He said that the nephew then punched him repeatedly and threw stones at his house injuring his wife.

Defence attorney, David Walter Ditiro asked the old man how he arrived at the sum of P40,000 and he replied that he suffered pains physically and emotionally. 'Right now my teeth are just a fake and he inflicted pain on my body.'When Ditiro told him that his client would tell the court that he had never assaulted him, the confident old man said that it would be because he (nephew) has a lawyer while he does not have one. The case continues.
