Bail for Kgafela?

 

The prosecution team has already made an application that the court grant a conditional bail as floggings continue unabated.

Last week, Nyamadzabo quashed the Bakgatla royals' application for their case to be transferred to Mochudi, saying it could jeopardise the proceedings.

Defence lawyers, Unity Dow and Banyatsi Mmekwa, representing Kgosi Kgafela and his younger brother, Mmusi Kgafela, and other tribesmen, are accused of unlawful floggings and damage to the Mascom tower.

The lawyers wanted their clients' cases to be transferred to Mochudi, arguing that the cases occurred in Mochudi so the state would be extending the cases to the appropriate audience.

However, Nyamadzabo said there was a shortage of security personnel in Mochudi, the fear that was earlier expressed by prosecution. Nyamadzabo stressed that 'it is against this backdrop that I agree with the state that it would be impractical to transfer the case to Mochudi'.

Besides, the regional magistrate said it would be cumbersome to dabble in administrative duties, going to Mochudi to execute the judicial proceedings. As in previous appearances, Bakgatla are expected to throng the Village court in great numbers to give solidarity to their Kgosi. Senior prosecutor, Kgosietsile Ngakaagae, represents the state.
