Court urged to tame Tempest

This comes after Extension II Magistrate Faith Dlamini Ngandu set December 14 as judgement day.

Tempest is charged alongside Lorraine Katakwe (21), who is alleged to have helped Tempest fondle a 13-year-old girl's breasts while causing her to rub Tempest's penis until he ejaculated.

Tempest, who is an aircraft instructor, is charged with indecent assault while Katakwe is charged with aiding and abetting.

At the close of its case, the state urged the court to return a verdict of guilty against the accused persons because the prosecution had proven its case beyond reasonable doubt. On the other hand, the defence counsel contends that his clients should be discharged because the prosecution failed to prove its case.

The defence argued that prosecution case was full of contradictions and should not therefore be allowed to stand.Section 146 of the Penal Code states that any person who unlawfully and indecently assaults any person is guilty of an offence and is liable to imprisonment for a term not exceeding seven years with or without corporal punishment.
