Produce case record or quash conviction says Mothusi

Mothusi's application follows his long standing appeal which apparently cannot be heard because the case record at the Magistrate court cannot be found.

According to Mothusi's attorney of record Lizo Ngconco, his client's rights to a speedy trial are being infringed upon by the long delay. Ngconco said his client was convicted in May 2008 and since then many other appeal cases that came long after his have been dispensed with. In his view a record must be reproduced so that his client's appeal should go on or if the record cannot be reproduced the court should state otherwise. The case is before Justice Michael Leburu.
