Dingake-Marole appeal removed from the roll

 

Former employee of Debswana, Donald Gaetsaloe, who got the High Court order to access the mobile phone of the   phones of the two gentlemen said he was not aware that the case was not in the roll. He told Mmegi that he will consult his legal advisors on the matter. Later he said that he could not comment on an on-going case. Dingake, a judge at the High Court declined to comment on the removal of the appeal when contacted.

In the substantive case at the High Court, Gaetsaloe challenged his dismissal from Debswana and lost. He alleges that the High Court decision loss largely came because of what he claims to be an untoward relationship between Dingake and Marole. He claims in his appeal that he lost the case against his dismissal at the High Court because Marole bribed Dingake, the presiding judge with P1.5 million to rule in favour of Debswana.

Gaetsaloe has demanded to be given access to the phone records and bank details of the High Court judge and Marole. Late last year, Justice Monametsi Gaongalelwe of the Lobatse High Court ordered Dingake and Marole to release details of mobile phone communication between them. In addition, the judge ordered the Botswana Unified Revenue Service to provide all tax returns submitted by Dingake. Dingake appealed the decision but yesterday, it was discovered that the matter was not in the Court of Appeal roll.

Although they have not had their day in court, Marole and Dingake were allegedly going to tell court that they have never had any dealings and the suggestion that they engaged in anything untoward or they had dealings is prepostrous.
