Sebele relatives in court for threatening magistrate

 

Specially Nominated councillor Kabo Sebele and Kgosimotse Sebele have been remanded in custody pending their bail application by Molepolole principal magistrate Nehemiah Moguni today.

 Yesterday, the duo together with Motlhabatsatsi Nkonyane appeared before Magistrate Moguni charged with a single count of threatening the life of Dumisane Terrence Basupi, the magistrate who gave a four-year jail sentence to Kgosikwena Sebele after finding him guilty of stock theft.

Sebele is related to the accused persons.

Kabo was also charged with reckless driving. The trio are represented by attorney Dick Bayford while Kgosietsile Ngakaagae is standing in for the state. 

In presenting the case, the state argues that on February 8, 2010 the three accused persons at or near TAJ filling station in Molepolole acting jointly in concert without lawful excuse, threatened to kill Dumisane Terrence Basupi by making a gesture he understood to mean, I will kill you.

On count two which is applicable to Kabo alone, the state alleges that Kabo on the same day along Goo-Thato tarred road near TAJ filling station in Molepole drove his motor vehicle in a manner that endangered other road users.

Magistrate Moguni is expected to make a ruling on the arguments of both counsels. Ngakaagae submitted before the magistrate that the accused be remanded in custody because the offence was committed recently. He pointed out that their investigations are on-going and because the complainant is a judicial officer who incidentally has just delivered a sentence to the accused persons relative, his security could not be guaranteed.

He appealed to the court to consider the security of the judicial officer in the event that the accused persons are granted bail.

However, Bayford submitted that his clients be granted bail as the state had failed to show that they would consummate their alleged crime should they be set free.

On the fateful day, the complainant (Basupi) had just convicted and sent Kgosikwena Sebele, the relative to the accused to a four year jail term for stock theft.
