Date set for 21st Century battle

 

High Court Judge, Justice David Newman has ordered that the case be tried for 10 consecutive days from June 13-24 next year.

Justice Newman further ordered that counsels for both parties shall meet in Johannesburg on March 13 to finalise all outstanding issues, and shall file a proposed final pre-trial order no later than April 15.

Attorneys for Mogae and others were also ordered to file a final list of proposed exhibits to be introduced in evidence, and an appropriate bundle of documents before March 11 next year.

The case arose after a high level deal went awry leaving top figures facing-off in legal proceedings. The 18 applicants had moved an urgent application demanding that the High Court restrain and interdict Charles Tibone, Lawrence Lekalake and 21st Century Holdings from implementing the resolution of a meeting held at the company - 21st Century Holdings. The 21st Century is an association of about 40 citizen investors who have grouped together for the purpose of looking for investment opportunities. The company owns 30 percent of Stockbrokers Botswana.

The applicants are Mogae, Nganunu, Legwaila Legwaila, businessman Sam Mpuchane, McClean Letshwiti, Nkobiwa Sebele, Goabaone Mokama, Tshipa Mothibatsela, Ludo Makhwade, Letlhogonolo Dabutha, Alfred Dube, Dikokole Mosinyi and Dzene Makhwade-Seboni. There is also Kgarebe Investments owned by Aloysius Kgarebe, JDM Investments - a company owned by Nganunu and his son Dziki, - the two of them have deponed supporting affidavits - Letshwao Investments owned by Lesego Selotate and Lawrence Khupe, FGM Investments of Mogae, San Safaris of Emang Maphanyane, and Tsela Alliance represented by Matenge Matenge. The defendants are former minister Tibone, Lekalake, Liyanda Lekalake and 21st Century Holdings (Pty). Mogae and Company is represented by John Carr-Hartley of Armstrongs Attorneys while South African based advocate Werner Luderitz represents Tibone and others and Cyril Ziman.
