CMS accused lambasts investigating officer

 

Johnson complained to Village Magistrate, Barnabas Nyamadzabo, that he should have come for mention on Wednesday but never made it to court because 'I noticed that my warrant of remand has been tampered with, and upon closer examination, the signatures there were that of the investigating officer'.

He further told court that when he inquired about why he was not taken to court on the scheduled date, the officer said he had forgotten about him (Johnson).

In response, an officer from the Directorate of Public Prosecutions (DPP) told the court that she would pass the message on to the substantive prosecutors, Pricilla Israel and Phadi Solomon.

The case was then postponed for continuation of trial before Regional Magistrate Lot Moroka on August 20.

Nyamadzabo ordered that the prosecutors talk to the investigating officer to ensure that he abided by the court orders.

The state will call its last witness before it closes  its case.

The case, which involves defrauding CMS of P21 million, involves Johnson, Norman Maja, Aaron Babolele, Lebogang Kaisara, David Tumagole, Patrick Cole, Clement Molefe, Otsile Mosarwe, Abraham Marumo, Nthibo and Bee Jenamo Mfana.  All the accused persons are out on bail except Johnson and Tumagole. Tumagole has been convicted of two separate crimes by the High Court. He is serving five years for armed robbery and nine years for murder with extenuating circumstances.
