Bail for UB student charged with murder

 

The duo is charged together with Thabo Machola and Leabua Lekorwe for allegedly killing a Francistown Senior Secondary School student, Tsholofelo Madziba, in Block 3 in 2015. They allegedly stabbed her with a sharp object.

The state also alleges that the quartet robbed Madziba of P449 before proceeding to rob Ookeditse Nlanda of a mobile phone worth P500 after they killed Madziba on that fateful day. Nlanda spent a few days in Nyangabgwe Referral Hospital (NRH) after the gang allegedly assaulted her with a hammer on the head.

The prosecution is currently looking for Thabo who has been on the run from the law since late last year.

Thabo is believed to be in South Africa, the favourite refuge for Batswana murder suspects. South African authorities want assurance that all murder accused persons from any country who have escaped to South Africa will not be hanged upon being extradited to their countries of origin.

On Wednesday the state did not oppose Molosiwa’s application. Said Molosiwa: “We make an urgent application for bail pending trial. The state has just served us with a notice of non-opposition to our application. We submit that our papers are in order and therefore pray for an order in terms of the draft order.”

Lekorwe, who is currently in custody, did not apply for bail as he did not have the finances to look for an attorney to make an urgent application on his behalf.

Makhwade granted the duo bail in terms of the draft order. The court ruled that the duo shall abide by the bail conditions that were set by the lower court.
