Man admits killing girlfriend over cheating claim

 

During that fateful day, according to the facts, Gaseitsiwe and two of his friends were selling meat in Palapye using a donkey cart.

“The accused and his friends were drinking traditional beer called mokuru. Later at night they decided to go to a certain shebeen at Extension 7 for more alcohol and entertainment. At around 11pm they decided to go to home to sleep. On the way home, the accused parked his donkey cart at the place of one Onalethata Dikanono whom he suspected of dating Kgwediedule,” said the facts. Gaseitsiwe entered the home of Dikanono and he went to the room where Dikanono and Kgwediedule were sleeping.

He then started calling the name of Kgwediedule ordering her to come out of the room, the facts continued.  “The deceased refused to come out of the house. This prompted the accused to forcefully enter the house. A scuffle between Gaseitsiwe and the deceased ensued after the accused entered the house. Gaseitiswe then stabbed Kgwediedule with an Okapi knife that he used to cut the meat he was selling several times on her body, which led to her death. He then fled the scene of crime,” the facts added.

The police, the facts noted, were called and they later arrested Gaseitsiwe.

“Upon being interviewed by the police, Gaseitsiwe revealed that the deceased was cheating him with another man. He also told them that his intention was not to kill Kgwediedule but to unlawfully injure her with the knife. He said he did not have any lawful excuse to stab the deceased,” said the facts.

Asked by Moroka if the facts were correct and true, Gaseitsiwe answered in the affirmative.

Said Moroka: “The summary of facts constitutes the basic ingredients of murder… The accused’s plea of guilty is unequivocal. I also make a finding of extenuation circumstance based on alcohol consumption and simultaneously find that his action was not premeditated.”

State prosecutor Khani Khani then told the court that the accused-who was on bail before being arraigned for facts reading, was yet to be fingerprinted to ascertain if he has previous convictions or not. “I apply that the accused should be fingerprinted to know if he has previous convictions or not,” said Khani. At the end of the proceedings, Moroka cancelled Gaseitsiwe’s bail and ordered that he be remanded in custody until sentence.
