Kutuku man guilty of attempted rape

 

The convict was initially charged with rape, but Keakantse found that no actual penetration had actually taken place. The court heard that on February 8, 2014, Motshoboje spent time with the victim and her family before leaving to the lands.

He later returned in the evening whereupon he slipped into the victim’s blankets and attempted to rape her. otshoboje ran off after his victim screamed, but was identified by both the victim and her daughter. A DNA test from the forensic laboratory later linked him to the offence.

During trial, Motshoboje denied returning from the lands to the woman’s home, entering it and attempting to rape her. He brought along three witnesses, who were however dismissed by Magistrate Keakantse as untruthful. “They failed to confirm where Motshoboje went to after parting ways with the complainant before the offence occurred,” she said.

The convict will appear for mention on September 13, 2017 where the prosecution will present his previous convictions if any, and he will render his mitigation.  Meanwhile still in court, Kedifentse Serobamotho of Sekoma pleaded guilty to defiling a 16-year-old girl. The incident took place in January 2010.

The prosecution said they did not anticipate a plea of guilty from the accused and the case was postponed to September 12. Serobamotho is out bail.
