State prosecutor, Oamogetswe Gaboutwelwe pleaded with Broadhurst Magistrate, Lilian Madabane to postpone Modenga’s case to next year as the investigating officer is still carrying out investigations.

Modenga is facing four counts of obtaining by false pretences, the offenses he allegedly committed in March 23 and May 8 this year near Phakalane Golf Estates in Gaborone.

“Investigations into this matter are still ongoing hence pleading with this court to further extend the accused persons’ bail and set another mention date in which I will be able to update court on the progress of the investigations,” Gaboutwelwe said.

Modenga seems to be a magnet for trouble as a warrant of arrest was issued against him for contempt of court in September. Even though he managed to give valid reasons that saved him from prison, the former deputy mayor is not yet off the hook.

At the time of his arrest in May, the Botswana Democratic Party civic leader spent a few days in jail before he was taken to Princess Marina Hospital where he was hospitalised for several days. He was granted bail upon being discharged from hospital.

According to the court papers, Modenga pretended to be an employee of the Department of Road Transport and Safety (DRTS) in order to obtain P1, 400 from one Talent Chepanda claiming that his vehicle had defects.

On second count, Modenga allegedly defrauded the same Talent Chepanda P1, 400 claiming that his truck had defects.

On the third count, it is alleged that on May 18, 2017 still in Gaborone, Modenga obtained money amounting to P1, 350 from Mmoniemang Motsamai pretending to be an employee of the DRTS and claiming that he was going to book a road test for the complainant’s son knowing that it was not true.

In the fourth count, he was accused of defrauding the same Motsamai of clothes worth P6, 800 on May 18, 2017 pretending that he was going to sell them on her behalf. Since 2015 Modenga has been making headlines with similar offences something that it is alleged to have forced his party colleagues to demote him from his former position. He currently has other cases of similar offenses before Francistown Magistrates Court.

Mmegi has however learnt that Modenga has paid some of the people he has cheated and remained with a few balance on the other victim. Modenga is due in court January 29, 2018.
