Maluleke was seen to be hostile to Nyalala Pilane and accused of being soft to Kgafela whom he referred to as “His Majesty” throughout the commission process.  At some stage he notified Nyalala of imminent issue of warrant of arrest as Nyalala continued to fail to comply with commission demands particularly on producing of financial statements of the Bakgatla kingdom believed to be worth around R36billion.

According to the legal experts appointment and proceedings of commission will not be affected by death, removal from office, etc., of its members or of the

Premier. The appointment of a commission shall not lapse and its proceedings shall not in any way be affected

l By the death, removal from office or resignation of a member of the commission, provided the vacancy arising in the commission is duly filled within fourteen days of the occurrence of such vacancy;

l By the death, absence, removal from office or resignation of the Premier who had appointed the commission.

Premier Supra Mahumapelo instituted the commission, believe to be anti Nyalala Pilane. Bakgatla now fear that the new commissioner may not be equally amenable to their coarse. This may also be Kgosi Kgafela Kgafela II biggest worry.
