Serial rapist dubbed 'Forest Evil' jailed for 45 years

 

Thatayaone Nka, 28, dubbed Forest Evil because he committed most of his offences in the forest has other pending rape cases before different magistrates in Francistown.

When passing sentence, the then principal magistrate, Dumisane Basupi said what was worrying about what Nka did was the fact that he raped schoolgirls when they were on their way to school in the morning. Nka was sentenced to 15 years in jail for each of the three offences that he committed on different dates in 2015.

He was additionally sentenced to 10 strokes for each of the offences, but Basupi said that the strokes should run concurrently.

The court heard that when Nka committed the harrowing incidents, he used violence on his victims sometimes threatening to stab the victims with a screwdriver and knife.  Said Basupi: “The accused has committed serious offences. The legislature impresses upon the court to pass a mandatory sentence of 10 years.

To show how serious the offences are, the legislature at Section 142 (5) says that sentences of this type of offences shall not run concurrently with any other sentence.” Basupi also said that he took into consideration that the accused has two young children who he is taking care of.

“I must comment on what transpired when the complainants testified in court. Each of their testimony was like a replay of a horror movie.

The girls were in tears during cross-examination. Justice Moses Chinengo as he then said if violence was used during the commission of the offence, the accused should be sentenced to a minimum of 15 years in prison,” Basupi said.

After passing sentence, Basupi also made an order that all of Nka’s victims should undergo counselling until such a time that the counsellors are satisfied that they are emotionally stable.  Nka was advised to appeal his conviction, sentence or both at the High Court in 14 days if he is not satisfied with the conviction, sentence or both.
