Suspended students win court battle against Mega Size

Justice Godfrey Nthomiwa rule that all the expulsions and suspensions imposed on the students be lifted immediately. The applicants on the matter include Atamelang Rapajane, Thabang Gaetwesepe and Ikanyeng Katse while the respondents are Mega Size Business and Computer College and Sylvester Seleka.

The students and college management had misunderstanding after the students requested their issue of accreditation courses to be heard urgently and wrote letters inviting all stakeholders involved on the matter.

“An order interdicting the respondent, its agents, employees or any persons acting under the instruction of the respondents are interdicted from denying the applicants access to the main campus premises which include but are not limited to learning facilities, library and any other facilities which the students are entitled to enter or utilise by virtue of their admission at Mega Size College,” Nthomiwa ruled.

The ruling also interdicted the respondents from suspending the applicants from the college.

It says, “alternatively, an order instructing the respondents to grant the applicants supervised access to Mega Size College to resume their education and learning facilities which are on campus in order to attend classes, write their internal examination, execute their module projects and any other activity incidental to college life”.

The court instructed the respondent to avail special and remedial arrangements to the applicants to recover any lost study time due to the suspension imposed upon them.

The respondents were ordered to allow the applicants to take any assessments, tests, internal examinations and any other academic related activity, which they missed due to the suspension. The interim order was to effect immediately pending the finalisation of the hearing against the applicant.

The applicants were to file review proceedings within 30 days and respondents were ordered to pay the cost.

The Youth League for Alliance for Progressives (AP) had engaged the attorney,Yandani Boko on behalf of the students while Patrick Matlho appeared for the college.
