Mothusi wants P34 million from gov�t

Mothusi last week issued a 30-day statutory notice against the Attorney General, Directorate on Corruption and Economic Crime and the Commissioner of Police for malicious prosecution and closure of business operations.

“Reference is made to the above subject matter with particular reference to the malicious prosecution and closure of operations of the plaintiff, as at May 2008, after a protracted ill-advised joinder of the plaintiff, as everywhere was a calculated risk by defendants' officials, in the due execution of their duties and not on a frolic of their own,” reads Mothusi’s court papers.

“Consequent to the unlawfulness and none justification of defendant’s joint actions, plaintiff sustained serious financial loss for the period of May 2008-February 2016. All attempts to acquire alternative employment were thwarted due to the non-timeous court process exacerbated by the loss of material evidence in favour on the none credibility of the founding suspicion,” Mothusi wrote.

Mothusi wants payment of the sum of P1.9 million; special damages for the encroachment in his right to privacy as enshrined in the constitution in the amount of P5 million; P100,000 for office equipment and furniture thrown onto the streets by the deputy sheriff; P5 million lost in the futile and malicious attempt to silence the innocent sheep; P560,000 for a Range Rover; P50,000 for a Nissan Hard Body; P100,000 for a Dodge Calibre; P180,000 for cattle and small stock that went stray because of an unpaid herdboy.

Mothusi also wants to be compensated P1.7 million for his double storey house in Block 5; Residential plot in Borolong at the value of P50,000; ploughing field in Shashe valued at P100,000; loss of business and clientele in pro deo matters due to his suspension at P500,000; reconnection of BTC facility and banking facilities at P1,500; wrongful termination of lease at P180,000. 

Mothusi was readmitted and enrolled to practice as an attorney in November 2015 after he was removed following his conviction in 2008. Mothusi was initially charged alongside another lawyer, Herbert Sikhakhane.
