Soldier up for stepdaughter sexual assault

Based at the Area S military garrison but cannot be named for ethical reasons, the soldier was originally facing three counts of raping the young girl, but has applied for a “no case to answer,” through his attorney, Kagiso Jani.

Yesterday, Basupi ruled that while the state had not proved beyond reasonable doubt that the accused actually raped his stepdaughter, evidence pointed to attempted rape on three occasions.

Basupi said the medical report produced by the prosecution as part of evidence showed that the child had not been penetrated but there was a prima facie evidence the soldier attempted to rape his stepdaughter.

After he was told that he was facing three attempted rape charges, the soldier opted to give unsworn evidence and is due in court on July 13 for continuation of trial.

In court the complainant testified that she reported the matter to her Guidance and Counselling teacher because she was psychologically affected by what her stepfather did to her.

She said during one of the occasions,  her stepfather allegedly raped her, he started kissing her but was unable to penetrate her.
