Nkomazana�s Bail Application Rejected Once Again

Nkomazana has been denied bail several times in the past by the Extention II Magistrate and the High Court respectively, but seems relentless in his quest for freedom, this time with the Broadhurst Magistrates’ Court.

Despite his case having been moved to the Regional Magistrate Court, Nkomazana decided to try again to apply for his bail through the Broadhurst court, which too turned down the plea.

Nkomazana is accused of swindling his late employer, Solomon Tlhapane of monies amounting to P3.9 million.

The prosecution argued that there was no change of circumstances and he could not be granted bail. The prosecution further stated that the accused person had two identity (ID) cards and he pleaded not guilty to the charge of giving false information in relation to his acquisition of the ID card and Botswana passport.

They also said on the other hand Nkomazana informed the court that he had a valid travelling document as such he was not a flight risk if he was to be released on bail whilst knowing that information was false. Before the regional magistrate, Chris Gabanagae last month, the 36-year-old pleaded with the court to assist him with the recovery of his properties.

He told the court that he wants the Investigating Officer (IO) in his case to return properties and a P190,000 that allegedly went missing at his house during his incarceration.

Nkomazana said at the time of his arrest, the IO, detective Senior Superintendent Sergeant Marapo confiscated the remote for his motorised gate, but some property including cash amounting to P190,000 went missing from the house.

The State alleges that Nkomazana together with Letlhogonolo Makgane (a lawyer), Billy Molefe, Motlalepula Molefe on or about February 5, 2016 at or near Senamela Sekga Attorneys in Gaborone, fraudulently obtained P3.5 million from Leonisa Investments (Pty) Ltd duly represented by Benny Thomas.

The charge states that they falsely pretended that they had been authorised to sell and dispose of immovable property being lot number 3032 situated at Extension II belonging to Nkomazana’s deceased employer, when in fact he did not authorise them to do so.

On the second count, the state alleges that Nkomazana and another person not before court on or about September 19, 2016 defrauded Tebogo Koketso of P600,000 purporting to have sold her a ploughing field located at Ruele lands in the Bakgatla Tribal Territory.

The state argues that the owner of the property, Tlhapane did not pass ownership as he was late.

On the third count, the state alleges that Nkomazana and his girlfriend Ketshephile Lempehu failed to bury the late Tlhapane between August 9, 2016 and November 20, 2016 at Tlokweng.

Other charges include bribing officials from the National Registration Office to obtain Omang and a birth certificate and also bribing officials from the Department of Road Transport and Safety to fraudulently obtain a Botswana driver’s licence.
