Accused makes U-turn on rape charges

 

In the previous mention, Mmoloke Makombe, 31, voluntarily agreed to the offence only to make a change the plea on the eleventh hour when the summary of facts we read to him. 

The state alleges that Makombe raped his 35-year-old victim at Monarch Area 11 on May 28, 2015. 

According to the police, on that fateful day, Makombe gained entry into the house of the cousin of his girlfriend at night. 

The police said that he then proceeded to the bedroom of the complainant before raping her once without using a condom.

Makombe, according to information gathered by the police, then went away but the complainant managed to identify him since he was well known to her. 

The complaint was later taken to Nyangabgwe Referral Hospital where a sexual assault kit was prepared and sent to Gaborone for forensic analysis. 

The accused was arrested on July 9, 2015 after sometime on the run whereupon some blood samples were extracted from him. 

The prosecution said the DNA profile taken from the control blood obtained from the victim’s panty and blood sample obtained from the accused matched.

After Makombe denied the facts, Chief Magistrate Thebeetsile Mulalu said: “The plea of guilty is altered after the accused disputed the facts. The matter shall now for trial.”

The accused was further remanded in custody pending trial on January 29 and 30.
