No invite for rejected candidates in Judges� position

Molale told Parliament this week that he was not aware of any invitation to the bench of candidates whose recommendations were rejected by President Ian Khama.

He explained that in the case of Omphemetse Motumise the recommendation followed an advert for the post of the judge, following retirement of Judge David Newman.

“In view of the Court of Appeal (CoA) in the Motumise matter the issue regarding the rejected for positions of Judge, their appointment should be a matter for consideration by the Judicial Service Commission (JSC).” 

Molale noted that the CoA judgment that Motumise be appointed a Judge must be viewed in the context of the advertisement. 

In the case of recommendations for Lizo Ncqoncqo and Gabriel Komboni who were rejected by the President, Molale said they were made long before the advertisement for the post, which was created by Newman’s retirement.

Molale was answering a question in Parliament from Gabane-Mmankgodi MP, Major General Pius Mokgware.

Mokgware had asked the minister if it was true that two of the candidates rejected for positions of judge of the High Court who were previously recommended for appointment by the JSC can come forward to be appointed and if so have they been invited.
