GU committee granted leave to appeal

In a case in which a group of disgruntled GU supporters led by Molatedi Diole, are challenging the legitimacy of the current executive committee, the court had dismissed the committee’s preliminary points that sought to bar the case from going ahead, into the merits.
The then respondents, who are the GU committee through their lawyer, Lore Morapedi had argued that the case be dismissed because the applicants, being the supporters, did not follow certain procedures.
One of them was that they failed to cite a relevant officer and brought their review four months after the completion of the proceedings, which they are complaining about. The committee lost the case which was dismissed with costs. The two parties had to argue the merits of the case last Friday. Morapedi told the court that the issue had to be dealt with before the merits of the case are argued. He said it would be sensible to deal with the matter the way his party has suggested, with the motions dealt with first.
Morapedi asked for time to look into the documents. On the opposing side, representing Diole and the group, attorney Uyapo Ndadi argued that the argument of motions should not be moved to a later date indicating the time aspect as his reason. “We have prepared heads of arguments for leave to appeal. I do not agree that it should be set for a later date,” he said.
For her part, Justice Dambe told the court that the matter is moved to November 13 where there shall be for hearing and application to appeal. She said both parties would have right to take the matter to the Court of Appeal after an appeal of the March ruling is heard.
Meanwhile, the Botswana Football Association (BFA) and former Botswana Premier League secretary general, Setete Phuthego has reached a settlement agreement.
Phuthego dragged the BFA to court in 2012 as he challenged his dismissal. On Friday through his legal representative, Amogelang Thaga Phuthego, he told the court that the two parties have agreed to settle out of court.
