He dragged the BFA before the court challenging his suspension.

Mpiwa was suspended last December following a forensic audit that reportedly unearthed gross maladministration and financial irregularities.

He was then called for a disciplinary hearing by the BFA on March 21. Mpiwa through his legal representative, Tirelo Makgane argued that he was not given ample time to prepare for the hearing and despite forwarding his grievances to the disciplinary committee chairperson, Billy Leselwa, the latter continued with the proceedings.

On Thursday, Judge Tebogo Maruping said the continuation of proceedings that were held by the BFA was unlawful based on the attitude of the then chairman of the disciplinary committee. He said Leselwa’s actions were suspicious as he could have prejudged the case. “The attitude of the chairman of the disciplinary committee raises the suspicions that he had prejudged the case before the hearing on March 21. In this manner, the court has to agree with applicant that the second respondent acted unlawfully,” Maruping said. He however gave the BFA another opportunity to reconvene the hearing within 30 days, provided they change the DC chairman. The BFA will however have to convince the court why the order should not be made final on April 28.
