Majaga to apply for permanent stay of prosecution

The state alleges that Majaga, Shadreck Mochabange, Tshokolo Mochabange, Semphete Malindi and Goletswang Mpule were found in possession of meat and hide of a cow suspected to be stolen on August 16, 2006.

They were arrested at Komtsia cattlepost near Dukwi. The case was dropped in 2014, but was reinstated this year.

While the other accused appeared in Court yesterday, Moffat Dick from the Directorate of Public Prosecutions (DPP) said Majaga had been excused from Court because he was attending to an emergency.

Dick added that he had agreed with the accused’s attorney that Majaga should be excused from attending Court. Dick explained: “We had intended to serve the accused with a new charge sheet, but in view that they want to move an application of permanent stay of prosecution at the High Court, we have to wait for that process.”

The accused’s attorney, Morris Ndawana told Magistrate Jennifer Chikate that he had just been served with a new charge sheet.

“Our view is that it will be better if the matter is postponed to another date to consider the new charge sheet. We want to apply to the High Court for permanent stay of prosecution, but that is subject to further consultations with my clients,” said Ndawana.

Chikate adjourned the matter to May 9 for the new charge sheet to be read to the accused and the accused to motivate reasons why they want to make an application of permanent stay of prosecution at the High Court before the substantive magistrate in the matter, Kose Makobo.

In the past, Majaga had objected that the matter was politically motivated because since it was registered, it always resurfaced when an election period neared.
