Man faces charges of murdering his father

 

Gabashe who originates from Mokgomane is alleged to have on August 27, 2016 in Mokgomane village, stabbed his father, Olefile Gabashe with a knife to death following an argument and also used a tyre lever in committing the crime. In October 2016, a psychiatric evaluation report ruled that the accused person was fit to stand trial.

The State prosecutor, sub inspector Dumani Chakasala said the police needed a court order for social workers to assess the accused person’s residence before admitting him to bail.

“The substantive prosecutor had earlier requested an order for the social workers office to carry an assessment at the accused persons homestead to find out if it is a conducive place where he can stay whilst on bail,” he said.

The accused said he was old enough to take care of himself and said if the court denied him bail it should avail a ruling to apply for bail at the high court.

“I am old enough to take care of myself, I have not been under a social workers’ care all along. I had not been staying with those people all along and I will not be going to that place.

I am a shoe-maker and I can sustain myself anywhere I am. If this court intends to deny me bail, it must be clear and there should be a ruling so that I apply to the high court,” Gabashe said.

Magistrate Modise said the substantive magistrate who was handling bail issues has been transferred hence he referred the case to the high court on accused persons request. He said the social workers assessment would ensure the accused person’s safety.

“The social workers assessment is necessary for your safety. Other family members and friends may revenge but I will transfer the matter to the high court as you requested,” Modise said.

In another matter, Barolong paramount chief Kgosi Lotlaamoreng’s younger brother, Montshioa Bernard Montshioa alongside his cousin, Thabang Montshioa’s bail conditions were varied.

The duo faces charges of bar breaking in that they allegedly (on January 18, 2017) broke into Motimalenyora bar in Goodhope village and stole alcoholic beverages worth P 8,000.

Magistrate William Modise said instead of initial P3,000 cash bail, the duo would be admitted to a P1,500 cash bail each and both avail two sureties whom will each pay P 700. Other bail conditions are that they report themselves daily at Goodhope Police Station and not to commit any offence whilst on bail.

The case will mention on March 23.
