Man convicted of passion killing

 

After deliberations, Justice Lot Moroka found Oduetse Mompoloki guilty of the 2014 murder of Gaonyadiwe Gaolaolwe.

Mompoloki will appear in court on March 28 for mitigation and to find if there are extenuating circumstances that led to his gruesome action.

Passing judgement, Moroka said that central to the allegations is that Mompoloki is facing is the fact that he and the deceased were live in lovers.

“On the day the deceased met her fate, she had gone to a shebeen to entertain herself with a female colleague. She told her friend that she was having problems with her boyfriend and they had since split. The accused followed her to the shebeen and assaulted her, which led to her death. She was certified dead upon arrival at the hospital,” said Moroka.

The accused, Moroka said, told the police that he assaulted the deceased and he even gave a confession statement to the effect that he indeed killed the deceased.

“The deceased died of injuries she sustained to the head…I find the assertion that the deceased died because she earlier on fought with other shebeen patrons to be false beyond reasonable doubt. While the doctor who examined the deceased said she died because she was repeatedly assaulted, the accused said that he only slapped her once which I find to be false,” said Moroka.

“It is not true,” Moroka said, responding to allegations that the deceased died because she was asthmatic.

“The prosecution has proved its case against the accused beyond reasonable doubt. The prosecution rightly pointed out that the deceased died because of injuries occasioned by the accused.

The accused’s actions were not legally justified and were fuelled by the fact that the deceased had dumped him. I consequently find him guilty of murder as charged,” said Moroka.

After the judgement, prosecutor Gonayaone Ketlhapetswe applied for the accused to be fingerprinted to check if he has previous offences or not.
