Mamelodi charged with misconduct as hearing starts

This follows Mamelodi’s unsuccessful effort to stop the hearing at the High Court on Monday. He faces charges of gross misconduct.

 Justice Lakvinder Walia had ruled against Mamelodi who had applied to the High Court seeking interdiction over a disciplinary hearing with the association.

Walia ruled that Mamelodi should appear before the disciplinary committee but also ordered the association to provide him with all the necessary documents within two weeks. The association was also ordered to schedule the hearing at a date not later than April 28.

BFA spokesperson, Tumo Mpatane confirmed yesterday that the disciplinary hearing has started but refused to shed more light on the matter because of their believe for “professional courtesy”. He said they will not want to put their employer’s matters on public front. “We will not speak to the issue of charges but as for the dates, our hearing started today (Tuesday),” he said.

At the High Court on Monday, Mamelodi’s lawyer, Dutch Leburu had argued that his client has been called for disciplinary hearing based on the findings of the audit but that he (Mamelodi) has not been called up to explain anything when the audit was done. He said his client does not even have transcripts of the witnesses who testified against him during the audit.

Leburu went on to say that some of the offences levelled against Mamelodi relate to the old contract and not the current one which started in October 2015. Mamelodi’s current contract comes to an end in September this year.

However the lawyer representing the association, Otto Itumeleng countered the argument saying Mamelodi should still appear for a disciplinary hearing and defend himself against the charges.

He said the suspended CEO can still call witnesses and appeal the final ruling if he feels aggrieved by it.
