'Serial gang rapist' denied bail

Denying the accused bail, Justice Lot Moroka said that it would not be in the interest of society and justice to grant Kabelo Nkgakile bail since there was evidence before court that he has the propensity for committing similar offences whilst on bail.

Moroka said that an affidavit signed by the investigations officer in the matters that the state prosecutor Kelebogile Kakoma relied on convince the court to deny Nkgakile bail shows that Nkgakile has the propensity to commit similar offences whilst on bail. 

Moroka added that since the investigations officer has also stated in his signed affidavit before court that Nkgakile escaped without trace for about five months after he allegedly committed one of his offences, it would not be in the interest of justice to grant him bail since he was a flight risk.

Earlier on when motivating his plea to be granted bail pending his trials, Nkgakile unwittingly incriminated himself by stating that he will not commit any rape offences whilst on bail because he had since experienced that life in jail is very unpleasant. 

He also stated that he was not a flight risk since he was arrested at his parents’ place in Mmashoro. 

“Contrary to what the investigations officer said, I have never escaped. I am a person who survives by doing piece jobs, so the police should understand that I move from place to place looking for piece jobs in order to survive since my parents are deceased,” Nkgakile unsuccessfully pleaded with the court.

According to the prosecution, Nkgakile is awaiting judgement in one of his alleged rape cases; one is partly heard while another has not commenced because the other accused person in the matter is still on the run.

In the case that has not yet started, Nkgakile is jointly charged with his cousin for allegedly gang raping his cousin’s grandmother.
