Assaulted boy has breathing complications

The 12-year-old boy was assaulted and critically injured by a Bangladeshi businessman, Mahommed Hussein Molla who knocked his forehead against a wall on June 13, 2016. He had to undergo surgery but since then, he has been in and out of the hospital.

The state prosecutor extended the remand warrant of the accused saying that they are waiting for the medical report on the boy’s condition from South Africa. He said that the boy came back from South Africa on November 24 and was released into his parents’care the same day. He said that four days later, the boy was re-admitted at PMH with breathing complications. However, he mentioned that the complainant is not in the intensive care unit.

“We spoke to the doctor who is in charge of the complainant’s operation seeking a report from SA, but he indicated that he is also still waiting for it. He said that once it arrives he would compile it and forward it to us.

“We further ask the court to extend the remand warrant of the accused.

We will keep updating the court on the condition of the boy,” the state prosecutor said. Defence counsel said that they had planned to apply for bail based on the medical report from South Africa, but since it is not available they would apply for bail in the next court appearance.

Magistrate Faith Ngandu ordered the prosecution to avail the latest report of the complainant’s condition in the next mention. She said that the defence counsel should understand the complexity of the case and why there is a delay with the report from South Africa.

She said that the court has no jurisdiction to order authorities in another country to release the report quickly.

She said that it is more worrying that while the court is waiting for another report from South Africa; the complainant has been re-admitted. The case continues on December 19, 2016.
