The presiding Judge Michael Mothobi was unimpressed with the lawyer Otlaadisa Kwape representing the Attorney General (AG)'s conduct wondering why the government's principal advisor was not in court.

Kwape had told the court that after reading the answering affidavit filed by Jacobs' lawyers he then consulted the AG Abraham Keetshabe who responded that he wanted to respond to one or two issues.

Mothobi took issues with the submission. 'Shouldn't he be here? We have been postponing this matter several times. We have a WiFi here. You applied to court as amicus curiae but that is not how a friend behaves towards one another. The Attorney General must be sitting here. I spent the whole time here. I am not a best friend this morning. If you visit social media people are enjoying Christmas but not me. They are gaining weight and I am not,' Mothobi said before postponing the matter for one and half hours to enable Keetshabe to respond to the answering affidavit.
