Sesana�s son, Co mount war against state

 

Tshoganetso Sesana and six others are facing charges of hunting in a protected area, after they were arrested in the Central Kalahari Game Reserve (CKGR) few months ago. Their argument for the recusal of Mothuba is that she is the one who signed forms deposing the exhibits of the meat as perishable as a judicial officer.

The trio posits that biltong is not perishable and argues that she may be brought to give evidence on the matter as the case goes on and hence must recuse herself. The accused persons further want the state to save the proceeds of the sold meat into an interest bearing account and not the government coffers, as they may claim the money with interest once they have won the case.

In their application, the trio also further requests the court to grant them permission to conduct their own tests on the meat alleged to have been of game.

Meanwhile, the state has not yet furnished the accused with the report following the death of the investigator who conducted tests on the venison.

The investigator was reportedly found hanging on a tree along the Gantsi-Gaborone road, a few metres away from the New Xade turn-off.

Assistant superintendent, Kenneth Chipisane of Gantsi Police two months ago confirmed the death of the investigator.

“He worked for the Department of Wildlife as a biologist in Gantsi and his car was found a few metres away from his body,” he said.

In a brief interview, the lawyer for the accused, Thabo Malambane said they have not yet been furnished with the report.

“There are two issues to be considered; he may have concluded the report and may have departed before the conclusion of the report. The way forward will be determined by these factors among others,” he said.

The case continues on November 22 where the court shall deliberate on the issues raised.
