Zim man accused of raping girlfriend

The state alleges that the unemployed Ndabadzihle Mpofu raped his girlfriend on July 22, 2018 at Tonota. 

Mpofu pleaded not guilty to the charge after it was read to him when he appeared before Magistrate Game Mooketsi. 

The prosecutor Zibo Siwela told the court that he has filed a summary of evidence, which he has also served the accused with. 

Mpofu then asked the prosecution to tell him how many witnesses would be called to testify against him in relation to the charge. 

Mpofu said so after he realised that there were some discrepancies in the medical report and forensic evidence that the prosecution gave him. 

He said: “The names of the complainant in the medical report and forensic report (DNA results) are different.  I want to know if the DNA results will be used as part of evidence”. 

In response to what Mpofu said, Siwela admitted that there was a lack of compatibility between the names of the complainant in the medical report and forensic report (DNA results). 

He attributed the discrepancy to the doctor who completed the medical report. 

Siwela added: “We therefore pray for another date of mention to be set to enable us to correct the discrepancy”. 

Magistrate Mooketsi then advised Mpofu that the state has already indicated that it would not use the doctor’s evidence during trial. 

“You cannot dictate who the state should call to testify against you. That right is fully reserved for the prosecution,” said Mooketsi. 

Mooketsi then further remanded Mpofu in custody before advising him to come to court on March 1, 2019 for an initial case management conference.
