Rapist Bemoans 15-Year Term Too Harsh

The accused had once appealed his conviction and sentencing before Francistown High Court judge president Lot Moroka, after former Chief Magistrate Peggy Madandume sentenced him to 15-years’ imprisonment.

During the appeal, Moroka upheld the magistrate’s court decision.On Friday, Motshweneng appeared before Moroka requesting the judge to reconsider his sentencing or give him the go-ahead to appeal his conviction and sentencing at the CoA. The accused raised concerns that during his trial the prosecution had served him late with documents to prepare for his case.

“I am concerned by late filing that was done by the State. During my trial, I was served with the documents late, which did not give me ample time to prepare for my defence,” Motshweneng said.In response, Justice Moroka asked him to choose whether he came to raise his concerns or to request to proceed with his application to the CoA.

The then 40-year-old Motshweneng was convicted of raping his girlfriend and violently inflicting pain on her in October 20, 2008 at Manga ward in Mmadinare.
