Court orders state to return part of evidence

 

Ndlovu ruled this on Monday, at what was supposed to be the final appearance of the two accused persons at the Magistrate level, before the case is committed to the High Court for trial.The murder accused, Caroline Gwamolamba (38) and Bakang Godisang (26) will make a final appearance before a magistrate court on October 27.

During their investigations on the case, Broadhurst Police had confisticated amongst others a car (Corolla), which was used during the offence. The magistrate ordered that it be given back to the accused persons, who are out on bail, since it would not affect in anyhow the evidence to be brought before the trial court.

It remains to be seen if the state will opt for Godisang to turn state witness. Godisang previously accused the prosecution of trying to turn her into a state witness, a request that she said she turned down.

Since there were no witnesses  at the scene, the state has hurdles to cross as they would only be relying on the two’s statements.

Gwamolamba in her statements says the two decided to hire an unknown man at Zoom nightclub for P200 to light up the house in which the deceased and her ex-soldier boyfriend stayed, whilst her co-accused in her sworn statement said that it was Gwamolamba who got off the car, with a container full of petrol.

The two, who have been out on bail for quite some time, face a charge of murder when the case goes to the high court. They are accused of burning to death two sisters at their home in Block 3 last year December. The suspects believed that one of the sisters was dating Gwamolamba’s ex- soldier boyfriend and that he had allegedly impregnated her.
