Richard Awaits His Fate

Richard was summoned before the National Assembly disciplinary committee for alleged illegal political activism while employed under the Public Service Act (PSA).

The hearing comes two weeks after the dismissal of his urgent application to interdict the disciplinary process pending an intended constitutional challenge.

He had moved the application at the Gaborone High Court for an interim order while he sought proper interpretation of the statutes of law the assembly was using to charge him.

 In a brief interview after the hearing, Richard said he was awaiting the judgement due in seven days to hear the outcome.

He said he will only know what to do going forward after the judgement that.

“I still maintain that the law that was being used to charge me still does not apply to me or the current happenings and that it needs to be challenged,” he said.

Richard maintained that he still intends to challenge the law before court, as it does not only affect him but many other people that may find themselves in the same predicament.

He pointed out that Section 37 (c) of the Public Service Act (PSA) that the assembly was using to charge him was broad and that it covers employees that it should not cover.

“I still believe that the section and the general orders that the assembly was using still needs to be challenged as it raises constitutional points,” Richard said.

Richard further said the Act needed proper interpretation from the point of law as it infringed on his constitutional rights being freedom of speech and association.
