The Botswana Football Association (BFA) who are cited as the respondents in Mamelodi’s application has since reinstated him. However, the BPL board through their lawyer, Lore Morapedi applied to the court to be joined in the proceedings alongside the mother body, BFA.

Yesterday Mamelodi’s lawyer, Dutch Leburu asked the court for the matter to be moved since they intend to file another application regarding allegations contained in some documents they received from lawyers representing the BPL board.

Leburu told Justice Diratsagae Molomo that he received the replying affidavit from the BPL board late and had to consult his client regarding certain allegations leveled against him by the BPL board chairperson, Rapula Okaile. He said the board chairperson has made allegations that the BPL board’s suspension has since been lifted and would seek proof in the form of minutes. There was also an issue of the use of the current constitution and all the parties agreed that the registrar be approached for verification.

Although Morapedi did not object to Leburu and his client filing another application, he expressed concern that the matter is taking too long to be resolved. He said had the respondents filed their answering affidavits on time, the matter would not be in the current situation.

Justice Molomo directed that the second respondents, BFA verify with the Registrar of Societies which constitution was currently in use to avoid parties citing different documents. The BFA recently drafted a new constitution and the court wanted to be clear on which one is in effect.

The Court also heard that the BFA would not oppose the BPL board’s application for a rejoinder leaving Mamelodi as the only one opposing the application. The Judge informed both the BPL board and Mamelodi to be prepared to deal with the issue surrounding the powers of the board in as far as hiring and firing of the BPL CEO is concerned.
