Rapist Gets 10 Years In The Slammer

Mbatsi Chubiye, who has been remanded in custody since his arrest in September 2017, pleaded with the court to be merciful when sentencing him.

According to the charge sheet, the accused attacked, robbed and raped a woman in Maipaahela location near the railway line.

DNA tests conducted on the condom that was found at the scene of the crime linked Chibuye to the offence. Chibuye pleaded with the court to be merciful when sentencing him because he has a three-year-old child that he is taking care of.

“I am a youthful first offender who can greatly contribute to the development of the country if given a second chance in life,” Chibuye pleaded.

When passing the sentence, magistrate Game Mooketsi gave credit to Chibuye for pleading guilty to the offence.

She added that by pleading guilty, Chibuye saved the victim the trauma of reliving the incident in court. However, Mooketsi said Chibuye seemed to be on a mission to commit the crime because there was nothing compelling him to rob the victim of her goods and thereafter rape her.

The magistrate said that Chibuye did not give any convincing reasons that the court should consider to reduce his sentence.

“In this case the accused did not give any reasons that the court can take into consideration to reduce the 10-year mandatory sentence set by the law. The victim and society look at the courts to pass fair judgement on rapists. Rape leaves a permanent scar on the victim that cannot be erased,” Mooketsi said.

“The accused is therefore sentenced to 10 years in jail, which shall be backdated to the time he was first incarcerated.”
