Mamelodi, BFA fight reaches Court of Appeal

Mamelodi is appealing last year’s High Court decision, where he lost his challenge to have the forensic audit declared null and void.
A full bench of the Court of Appeal will hear the case.
Dutch Leburu of Monthe Marumo & Associates represents Mamelodi while the respondent, the Botswana Football Association (BFA) is represented by Joseph Akoonyatse of Akoonyatse Law Firm. The audit had revealed a rot at the BPL, and was primarily used to dismiss Mamelodi, who wants the report set aside.
South African firm, ADM Financial Forensic Services, at the instruction of the BFA carried out a forensic audit into the affairs of the BPL.
Mamelodi was suspended pending a disciplinary hearing. He was subsequently dismissed over allegations of maladministration, as per the finding of the forensic audit.
BFA had commissioned the audit report, for the purposes of instituting disciplinary proceedings against Mamelodi last year.
However, Mamelodi, through his lawyer, Dutch Leburu, then moved to have the court to annul the report as the applicant deemed it unlawful.
Mamelodi argued that the decision to dismiss him was purely based on a report that was not legal.
