The property company has now dragged him to court among others seeking an order to evict him from their building and for him to pay rental in arrears and utility levies.According to papers filed before court, Maretlwaneng who is being sued for breach of contract, was to let the space for a period of two years from March 1, 2014 until February 29, 2016.

He is now being sued for arrear rentals in the sum of P838,548.48, interest at a rate of 9.5 percent per annum from March 1, 2015 to date of full payment.

The applicants also want Dee Zone Productions to pay management levies in the sum of P144,944.89, an order for cancellation of the agreement of lease, damages for wrongful holding over and an order for eviction.

The court papers dated March 15, 2016 state that Maretlwaneng had failed to pay rentals for months of March 2015 to February 2016 and had also failed to pay levies.

“From the period between March 1, 2014 and February 29, 2016, the defendant has made sporadic payments to the facility manager for levies and utilities, leaving outstanding as at 29 February 2016 the sum of P144,944.89,” states the documents.

Moreover Maretlwaneng is being accused of refusing to vacate and hand over the premises to the owner despite the expiry of the agreement on February 29, 2016.

Meanwhile, according to the material of agreement as stated in the court papers, he was also to pay rentals, subject to annual compound escalation at 10 percent on a monthly basis and in advance in the sum of P63,526.40 from March 1, 2014 to February 28, 2015 and the sum of P69,879.04 from March 1, 2015 and February 29, 2016, VAT inclusive.

The agreement also stated that in failing to pay rental on the due date, the owner was entitled to cancel the lease agreement, repossess the leased premises and the defendant liable for payment of arrear rentals and damages.
