Government had been ordered to show cause why an order given two weeks ago in favour of BOFEPUSU freezing the increment, should not be made final.

Ruhukya, who said he was unimpressed with government’s conduct, postponed the case to allow BOFEPUSU an opportunity to respond to government papers.

State counsel, Bernard Bogosi apologised profusely to Ruhukya, stating that he filed the papers in court last Tuesday, but found out that BOFEPUSU attorney Mboki Chilisa was only served with papers late on Friday.

Two weeks ago Ruhukya delivered judgment in the matter, in which he held that the unilateral decision by government to award a three percent increase to the public service amounted to bargaining in bad faith.

He, however, noted that for the month of April, the adjustment in the salaries of the public servants had already been effected as demonstrated by the defendants, and as such the interdict would take effect from the month of May onwards.

The judgment was the interim order returnable to court yesterday and government was to show cause why the order could not be made final.
