Montshiwa murder:lawyer wants charge withdrawn

His lawyer, Kgosietsile Ngakaagae told the Village Magistrate court presiding magistrate Ike Raphael, that he advises the state to temporarily withdraw the matter until they have enough evidence against his client.

“Why can’t we be relieved whilst investigations are ongoing?” Ngakaagae asked.

Ngakaagae said that ever since David’s arrest last year, the police have not made any significant progress in terms of investigation. He said that the police have never briefed them about the progress of their investigations except to say the investigations are still at a critical stage.

“While we still wait for the state to introspect, we are calling for the state to withdraw the charge against the accused. When they are ready, they are free to reinstate the charge,” he advised.

Ngakaagae added that since his arrest, David’s life has been in limbo.

The state lawyer, Ernest Mosate however, maintained that there has been progress in the investigations. But, Mosate said he was not in a position to tell the court more lest he jeopardises the investigations.

“There are other people associated with the accused. Their whereabouts are still unknown to the police, this is why we cannot reveal much information on the investigations,” he said.

David, together with two others, is charged with the murder of Montshiwa who was shot dead at his home in Block 6 last year. The two co-accused will appear tomorrow, while David is set for status hearing on May 25.
