Leshman�s ex-lover withdraws application to appeal

Nthomiwa had ruled in favour of Leshman who Mabogo claimed owed her a sum of P319,339 from their honeymoon days.  

The case will now go back to court where it will be argued by both parties showing cause why the court should rule in either one’s favour. 

Mabogo had applied for a summary judgment with the hope that it would be smooth sailing for her, but Leshman aggressively opposed the move saying he did not owe Mabogo a thing. 

The two, according to court papers, fell in love around August 2012 and Mabogo moved in with Leshman at his Phakalane home along with her two children and a maid.

The transactions, which are now at the centre of the dispute, were entered into at a time when they were still on good terms and could share property freely.

Leshman opposed his ex-lover’s application saying his understanding of their exchange is that the money was a gift as is normal in any relationship.  

He further defended himself saying, “During those times, I cared for her, her two children and a maid without any contribution from her”.

He said at some point in their relationship, he shared his business financial challenges with Mabogo to which she came to the rescued with over P319,339.

The court papers further state that Mabogo instituted legal suit after Leshman kicked her out of his house.

He said he ended the relationship because Mabogo was possessive and wanted to know about his whereabouts at all times including calling suspicious contacts in his phone.

This he said, included calling some of his clients hence jeopardising his business interests.

Mabogo, however, argued that no reasonable person can give another such an amount and she wanted her money back, which she says was a loan to Leshman.

Leshman said the only amount Mabogo loaned him was P70,000, which she gave him in his capacity as the managing director of Leshman Holdings.

Leshman argued that it is irrational for Mabogo to say she loaned him such amounts without any evidence to prove her claims.   Mabogo, however, argued that Leshman knows very well that he asked for the bailout from her and that he should pay back the money.
